Terms and Conditions Family First

Terms and Conditions for International Day of Families Online Competition (“Competition”), sponsored by GEMS Group Holdings Limited Dubai Branch, a branch of a limited liability company registered in the Dubai International Financial Centre with license number 804262 (“GEMS Education”)

By entering this Competition, all participants agree to be bound by these terms and conditions.

 

Eligibility:

  1. The Competition is open to residents of the United Arab Emirates only.
  2. Participants must be aged 18 years or older at the time of entry. GEMS Education reserves the right to ask for proof of age and evidence to verify the identity of the participant at any time.

Entry Requirements:

  1. To enter the Competition, participants must share their favorite family picture on their Instagram profile.
  2. Participants must follow the official Instagram account of GEMS Education (@gems_education).
  3. Participants must include the hashtag #GEMSFamilyFirst in the caption/story of their Instagram post.

Submission Deadline:

  1. Entries must be submitted by 5pm GST on 29 May 2024.

Prize:

  1. One winner will be selected at random from eligible entries.
  2. The winner will receive a 12 month subscription to GEMS Rewards Plus family access, granting the winner access to certain gyms, beaches, and leisure clubs affiliated with GEMS Education.
  3. The prize is non-transferable and cannot be exchanged for cash or any other alternative.

Winner Notification:

  1. The winner will be notified via Direct Message (DM) on Instagram on 30 May 2024 via the @GEMS_Education Instagram page.
  2. If the winner does not respond to the notification within 48 hours, another winner will be selected at random.

General Terms:

  1. GEMS Education reserves the right, in its sole discretion, to disqualify any entry that does not comply with the entry requirements or violates these terms and conditions.
  2. GEMS Education reserves the right, in its sole discretion, to change these terms and conditions or to cancel, amend or suspend the Competition at any time without prior notice.
  3. This Competition is in no way sponsored, endorsed, or administered by, or associated with, Instagram. By creating an account on Instagram, you agree to their terms of use and privacy notice. If you do not agree to such terms of use of privacy notice, you cannot create an Instagram account to participate in the Competition.
  4. By entering the Competition, each participant agrees that no aspect of their entry, including but not limited to, their submissions, will (i) infringe the intellectual property rights of any third party; (ii) defame others, or include any content which is obscene, abusive, discriminatory, offensive, hateful or inflammatory; and/or (iii) promotes or incites violence or illegal activities.
  5. By entering the Competition, each participant hereby grants GEMS Education and each of our affiliates, and any other third parties acting on our behalf a fully paid up, non-exclusive, assignable, sublicensable, worldwide, perpetual license to display publicly and use for promotional purposes the submissions. This license includes, but not limited to, posting or linking to the submission on our and partners’ websites and applications, including our website, and display and promotion of the submission on any other media, worldwide.
  6. To the extent permitted by applicable law, GEMS Education’s liability under or in connection with the Competition or these terms and conditions shall be limited to the actual value of the prize in question.
  7. These terms and conditions are governed by the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates, as applied in the Emirate of Dubai. Each Participant agrees to submit to the personal jurisdiction of the courts of the Dubai International Financial centre for the purpose of litigating all claims or disputes.

Privacy:

  1. Competition entries and all information relating thereto or submitted in connection therewith is subject to the GEMS Education Privacy Policy, as stated on the GEMS Education website and as updated from time to time .
  2. Participation in the Competition constitutes consent to use the Participant’s submission, photographs, name, biographical information, image and likeness for editorial, advertising and publicity purposes without additional compensation, except where prohibited by law. The Participant releases and holds harmless GEMS Education and its affiliates for any liability, claims and causes of action based on defamation or violation of rights of publicity or privacy.
  3. Any personal data relating to the winner or any other participants will be used solely in accordance with applicable data protection laws and will not be disclosed to a third party without the entrant’s prior consent..
